These Terms and Conditions apply to all visitors, users and others who access or use foogolf.com.

All prices are in US dollars.

Once paid for, sessions cannot be cancelled, modified or refunded.

We are unable to refund you for unused hours. Please try our service before purchasing to make sure it is right for you.

Due to the many factors outside our control, we cannot guarantee that you will be able to connect your launch monitor. Please use the Night Range to test your launch monitor before making any purchase with us.

We are committed to respecting your privacy and personal information and will comply with the New Zealand Privacy Act 2020 in the collection, use, disclosure and storage of your personal information.

We will only use and disclose your personal information to third parties for the purpose of providing the services or as required by law.

We use cookies to allow you to log in securely to the site.

We use Google Analytics to learn how the our platform is being used, for example pages people are using the most, or where they might be having trouble.

We use Stripe to handle your payment. Your payment information is encrypted, and we do not have access to your debit or credit card information. The only data about your order that we can see is your email address, date and time of purchase, the amount spent and the last four digits of the card you used for payment.

You agree to keep your password confidential and not to share your access details.

Notwithstanding anything else in this Agreement and to the extent permitted by law, our maximum liability to you for any losses, damages, costs or for any claims howsoever arising directly or indirectly out of or in connection with this agreement or the supply of the services (in contract, tort, negligence, under an indemnity or otherwise arising from the parties’ relationship) is limited to direct losses or damages up the total fees paid by you in the month preceding the event giving rise to the loss or damage. For the purpose of this clause, direct losses or damages exclude:

- any losses or damages arising from delay, increase in operating costs, loss of profit, use, production, income, business or business opportunity, loss or corruption of information, data or records, contract or goodwill of any person;

- any indirect, or special consequential, incidental, reliance or punitive damages, losses, liabilities, costs or expenses; and

- any loss resulting from liability to any third party.

We will not be liable to you for any losses, costs or damage caused by events beyond our reasonable control, including any external factors affecting of the performance of the services, including internet connectivity, hosting provider failure and network breakdowns.

This Agreement is governed by and construed under the laws of New Zealand.
